JAKARTA, GISTARA GEYA, – As a member and initiator of Indonesian Operating Room Nurse Association (IORNA), Sukendar filed a lawsuit against the people in East Jakarta district court (PN); not merely he had been ousted, but there was an essential. The lawsuit was filed to seek justice towards the national congress results of the association, which a group of people conflicted with Association’s Articles of Association (AD ART). “I filed a lawsuit not merely because I had been ousted as a member of the board of IORNA, but my attitude towards the result of congress. The history, that Sukendar is the initiator, the founder struggling to establish IORNA. That is an essential that I filed a lawsuit,” said Sukendar
Meanwhile, Gerardus Gegen as his lawyer suspected AD ADT of IORNA had been blurred after mediation efforts failed to accomplish a settlement for each other. The lawsuit in PN was filed since the elected members of board had blurred AD ART. “This is the point, my client Sukendar, moreover, the founder of IORNA,” said Gerardus Gegen.
The congress of IORNA was held on June 1, 2023 and made deletions to the AD ART which was prepared since 2000. AD ART also has obtained the status of a legal entity, therefore it becomes more clear. There was an irregularity by making deletions to AD ART, and used organization regulations (PO) instead for the members. They derived PO from another organization of perioperative nurses.
A congress is a formal meeting where all members come together to discuss issues or questions. Besides, it often refers to all members to any important meeting or official organization. Therefore the lawsuit was filed in order to seek justice. “Sukendar is the founder, initiator though he is not listed in organizational structure. But that does not mean that they can make deletions to AD ART. By making deletions, AD ART which was initially prepared, but it was finally changed by another organization. The deletion of the provincial board (DPD) of IORNA is another problem. Therefore, congress and ART are biased. If we stick to AD ART, those things (biased decisions) must not happen.
